These Terms and Conditions ("Terms") govern your use of Crewflow ("the Service"), an AI-powered customer support platform operated by Enactory Ltd (Company Number: 15664650) ("we," "our," "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years of age to use the Service. By using Crewflow, you represent that:

• You are of legal age to form a binding contract
• You have the authority to bind your organization (if applicable)
• All information you provide is accurate and current

4.1 Permitted Use

You may use the Service to:

• Process customer support conversations through AI analysis
• Generate draft responses to customer inquiries
• Analyze sentiment and urgency of customer communications
• Integrate with supported email platforms
• Connect help center and customer data sources

4.2 Prohibited Activities

You may not:

• Violate laws or regulations
• Infringe intellectual property rights
• Process harmful, offensive, or illegal content
• Attempt to reverse engineer the AI models or algorithms
• Overload or disrupt the Service (e.g., DDoS attacks)
• Use the Service to spam or send unsolicited communications
• Share your account credentials with unauthorized users

5. Intellectual Property

5.1 Your Content

You retain all rights to the customer conversations and data you process through the Service. By using the Service, you grant us a limited, worldwide, royalty-free license to:

• Process your data to provide AI analysis and draft responses
• Store conversation data temporarily for service delivery
• Use anonymized, aggregated data to improve AI model performance

5.2 Our Intellectual Property

The Crewflow platform (code, AI models, design, branding, documentation) is owned by Enactory Ltd and protected by copyright, trademark, patent, and other laws. You may not copy, modify, or redistribute our software or AI models without permission.

6. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you agree to our Privacy Policy.

For business customers who process customer conversations via Crewflow, we act as a data processor. You are the data controller and must comply with GDPR and other applicable data protection laws.

7. AI-Generated Content

7.1 No Warranty on AI Output

Crewflow uses AI models to analyze sentiment and generate draft responses. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or inappropriate suggestions.

You are solely responsible for reviewing and approving all AI-generated content before sending it to customers.

7.2 Human Review Required

The Service is designed to assist human customer support agents, not replace them. Always review AI-generated drafts for accuracy, tone, and appropriateness before use.

8. Third-Party Integrations

Crewflow integrates with third-party platforms (email platforms, help centers, etc.). Your use of these platforms is subject to their respective terms of service.

We are not responsible for:

• Changes to third-party API functionality or availability
• Data loss or errors caused by third-party platforms
• Third-party platform outages or service interruptions

9. Termination

9.1 Termination by You

You may cancel your subscription at any time via your account settings. Access continues until the end of your billing period (no refunds for unused time).

9.2 Termination by Us

We may suspend or terminate your access to the Service if you violate these Terms, engage in prohibited activities, or fail to pay subscription fees.

9.3 Data Retention After Termination

• Account data: Retained for 90 days (restore available during this period)
• Permanent deletion: After 90 days, all data is permanently deleted
• Export before deletion: You may export your data within 90 days

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI-generated content.

You use the Service at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Errors or inaccuracies in AI-generated content
• Service interruptions or data loss
• Third-party platform actions or failures
• Customer complaints resulting from AI-generated responses

Our total liability is limited to the amount you paid in the 12 months preceding the claim (or £100 if greater).

11.1 Exceptions

This limitation does not apply to:

• Fraud or fraudulent misrepresentation
• Death or personal injury caused by our negligence
• Other liabilities that cannot be excluded under UK law

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
